3. No Collection, No Charge Policy
We operate on a contingency basis. You will not be charged any fees unless we successfully collect on your judgment. Our fee structure will be clearly outlined in your service agreement.
4. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your judgment
- Provide all necessary documentation related to your case
- Cooperate with our collection efforts
- Notify us immediately of any payments received directly from the debtor
- Maintain the confidentiality of any proprietary methods or information we share
5. Limitations and Disclaimers
5.1 No Guarantee of Collection
While we strive to collect judgments within 5-10 business days, we cannot guarantee successful collection or specific timeframes. Collection success depends on various factors including debtor assets and cooperation.
5.2 Not Legal Advice
Our services do not constitute legal advice. We recommend consulting with an attorney for legal matters related to your judgment.
5.3 Compliance with Laws
We conduct all collection activities in compliance with applicable federal and state laws, including the Fair Debt Collection Practices Act (FDCPA) where applicable.
6. Confidentiality
We maintain strict confidentiality regarding all client information and case details. Information will only be shared as necessary to perform collection services or as required by law.
7. Indemnification
You agree to indemnify and hold harmless Post Judgment Recovery, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your breach of these Terms
- Inaccurate or incomplete information provided by you
- Your violation of any law or third-party rights
8. Limitation of Liability
Our total liability for any claim arising from our services shall not exceed the fees actually paid by you for the specific services giving rise to the claim. We shall not be liable for any indirect, incidental, special, or consequential damages.
9. Termination
Either party may terminate the service agreement with written notice. Upon termination, you remain responsible for any fees owed for successful collections completed before termination.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your State], without regard to its conflict of law provisions.
11. Dispute Resolution
